Jobreel Terms of Service

Welcome to Jobreel! By accessing or using our platform (“Jobreel”), products, services, website, and applications (collectively, “Services”), you agree to comply with and be bound by the following terms and conditions (the “Terms”). The Terms include the provisions of these terms of service as well as our privacy policy, which is available here: www.jobreel.io/privacy.
You represent and warrant that you are of legal age to form a binding contract. If you’re agreeing to the Terms on behalf of an organization or entity, you represent and warrant that you are authorized to agree to these Terms on that organization or entity’s behalf and bind them to these Terms (in which case, the references to “you” and “your” in these Terms, except for in this sentence, refer to that organization or entity).
1. Account Registration and Use
Job Seekers
When creating a profile on Jobreel, job seekers are required to provide the following:
Mandatory Information:
First Name and Last Name: To establish your identity on the platform.
City/State: To assist in localizing job opportunities.
Profile Video: A 30-second video that showcases your skills, personality, and what you bring to potential roles. This is a key component of your Jobreel profile.
Optional Information:
Work Experience: You may choose to include details about your past employment to enhance your profile.
Educational Degrees: Information regarding your educational background, such as degrees earned.
Professional Certifications: Any relevant certifications that can bolster your qualifications.
Workplace Preferences: Details about your preferred working environment, culture, and other personal preferences.
Work Type Preferences: Your preferred employment type (e.g., full-time, part-time, freelance).
Providing optional information may enhance your visibility and attractiveness to potential employers, but it is not required for account creation. The choice to include these details is at your discretion.
Employers
Employers on Jobreel are required to provide comprehensive information to create a transparent and effective job listing. The mandatory and optional elements for employer profiles and job postings are as follows:
Mandatory Information for Employer Profile:
Business Name: The legal name of your company.
Business Address: The physical location of your company or the primary place of business.
Business Type: The category or sector your business operates in.
Profile Video: A 30-second video that showcases your workplace, culture, and what makes your company a unique place to work.
Mandatory Information for Job Postings:
Job Title: The title of the position you are looking to fill.
Job Details: A description of the role, including responsibilities and requirements.
Salary Minimum: The minimum salary for the position, clearly specifying whether it is hourly or yearly.
Job Type: The nature of the employment (e.g., full-time, part-time, contract, etc.).
Optional Information for Job Postings:
Salary Maximum: You may choose to include the maximum salary for the position. This can provide clearer expectations for potential applicants but is not mandatory
When registering as an employer on Jobreel, it is mandatory to comply with the following legal eligibility requirements:
Legal Ability to Hire: Employers must affirm and warrant that they are legally authorized to conduct business and hire employees or contractors in the jurisdictions where they operate. This includes, but is not limited to, having valid business licenses, tax registrations, and adhering to all relevant labor laws and regulations.
Compliance with Laws: Employers are required to comply with all federal, state, and local laws regarding employment practices, including anti-discrimination laws, wage and hour laws, and workplace safety regulations.
Verification: Jobreel reserves the right to request documentation or proof of an employer's legal ability to hire and conduct business. Failure to provide such documentation upon request may result in the suspension or termination of the employer’s account.
Non-Compliance Consequences: If an employer is found to be ineligible to hire legally or violates any of the terms and conditions outlined in this ToS, Jobreel reserves the right to take action. This may include, but is not limited to, suspending or terminating the employer's account, removing job postings, and barring future use of our services. Jobreel is committed to maintaining a safe and lawful platform for all users.
You will not share your account or password with anyone, and you must protect the security of your account and your password. You are solely responsible for any and all activity associated with your account.
2. Content Guidelines
All videos and content must be deemed appropriate. You represent, warrant, and agree that you will not publish any inappropriate content on Jobreel or using the Services. Inappropriate content includes but is not limited to:
Explicit Material: Content that includes nudity, sexual acts, or explicit imagery.
Violent or Graphic Content: Images or descriptions that depict violence, gore, or other graphic material.
Hate Speech and Discrimination: Language or imagery that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected categories.
Harassment and Bullying: Content that intimidates, demeans, or harasses individuals or specific groups of people.
False Information and Misrepresentation: Deliberately misleading or fraudulent information or impersonation of individuals or organizations.
Illegal Activities: Promotion of illegal activities or content that violates laws and regulations.
Spam and Malware: Unsolicited promotions, commercial messages, or content that contains harmful software.
Infringes, violates, or misappropriates the intellectual property rights of any other person.
Non-Professional Content: Jobreel is a hiring platform. Content that is unrelated to professional development, job searching, or workplace environments may be deemed inappropriate.
Users may report offensive content to support@jobreel.io for review. We reserve the right to remove any content or user at our discretion.
We have no control over and assume no responsibility for the content, accuracy, privacy policies, or practices of or opinions expressed in any third party websites or by any third party that you interact with through the Services. In addition, we will not and cannot monitor, verify, censor or edit the content of any third party site or service. By using the Services, you release and hold harmless us from any and all liability arising from your use of any third party website or service. Your interactions with organizations and/or individuals found on or through the Services are solely between you and such organizations and/or individuals. You should make whatever investigation you feel necessary or appropriate before proceeding with interaction with any of these third parties. You agree that we are not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. If there is a dispute between participants on the Services, or between users and any third party, you agree that we are under no obligation to become involved unless there is a clear violation of our rules. In the event that you have a dispute with one or more other users, you release Jobreel, Inc., its officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or our Services. If you are a California resident, you shall and hereby do waive California Civil Code Section 1542, which says: “A general release does not extend to claims which the creditor or releasing party does not know or suspect to exist in his, her, or its favor at the time of executing the release, and that, if known by him must have materially affected his settlement with the debtor or releasing party.”
3. Privacy and Profile Visibility
Job seekers may choose to make their Jobreel profile public or private. Public profiles are visible to all employers; private profiles are visible only to specific employers.
The terms of our privacy policy are incorporated herein by reference and shall continue to apply to your use of and access to Jobreel. While also stated in our privacy policy, the Children’s Online Privacy Protection Act requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 13. We do not knowingly collect or solicit personally identifiable information from children under 13. If you are a child under 13, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn we have collected personal information from a child under 13, we will delete that information as quickly as possible and terminate the associated account. If you believe that a child under 13 may have provided us personal information, please contact us at support@Jobreel.io.
4. Communication
Messages between users must align with the primary objective of job searching, recruitment, and professional networking.
We prohibit using the platform for other purposes including but not limited to:
Personal or Romantic Solicitations: Using the platform to seek personal relationships, dates, or romantic encounters.
Harassment or Bullying: Engaging in behavior that intimidates, demeans, or harasses other users. This includes sending unwanted messages, making inappropriate comments, or any form of cyberbullying.
Personal Advertising or Marketing: Promoting personal businesses, products, or services that are unrelated to professional development, job seeking, or recruitment.
Non-Work Related Content Sharing: Posting or sharing content that is unrelated to professional interests, such as personal photos, videos, or posts about personal life events, hobbies, or entertainment that don’t relate to the professional context of the platform.
Spamming Users: Sending unsolicited messages, especially in bulk, that are not related to job seeking, hiring, or professional networking.
Political or Religious Advocacy: Using the platform to promote political or religious beliefs, campaigns, or agendas, unless they are directly relevant to professional interests or the workplace.
Gossip or Slander: Spreading rumors, gossip, or engaging in slanderous behavior against other users or organizations.
Illegal Activities: Engaging in or promoting activities that are illegal or violate the terms of service.
Users must comply with fair hiring practices and anti-discrimination laws.Fair hiring practices apply to but are not limited to
Job Advertisements: Job listings should be neutral and not indicate a preference for or against candidates based on their protected characteristics.
Application and Interview Process: Questions asked should be relevant to the job and not discriminatory.
Hiring Decisions: Decisions should be based on the candidate's qualifications, skills, and experience relevant to the job.
Reasonable Accommodations: Employers should provide reasonable accommodations for disabled applicants and religious practices, as long as it doesn't cause undue hardship on the business.
Training and Awareness: Regular training and awareness programs for all employees involved in the hiring process to understand and comply with these laws.
The Services may provide access to videos or other content that were not created by us and for which we assume no ownership or liability. Any such access is provided for the use and convenience of users and does not constitute an endorsement, recommendation, or certification by us. We do not take any responsibility for the accuracy, currency, completeness or quality of information or content contained in the Services, nor for any harm caused by that content. As such, we will not be responsible for any errors or omissions or for the results obtained from the use of such information contained in the Services.
5. Reporting and Enforcement
Users can report inappropriate content or behavior to support@Jobreel.io. We reserve the right to suspend or terminate accounts based on reported violations.
6. Fair Use and Non-Discrimination
Employers must adhere to fair hiring practices and anti-discrimination laws in the United States.Key aspects include:
Title VII of the Civil Rights Act of 1964: This law prohibits employers from discriminating against employees or applicants based on race, color, religion, sex, and national origin. It applies to employers with 15 or more employees.
The Americans with Disabilities Act (ADA): The ADA prohibits discrimination against individuals with disabilities in all areas of public life, including jobs. It requires employers to provide reasonable accommodations to employees with disabilities.
The Age Discrimination in Employment Act of 1967 (ADEA): This law protects individuals who are 40 years of age or older from discrimination based on age in hiring, promotion, discharge, compensation, or terms, conditions, or privileges of employment.
The Equal Pay Act of 1963 (EPA): The EPA requires that men and women be given equal pay for equal work in the same establishment.
The Pregnancy Discrimination Act: This act amended Title VII to make it illegal to discriminate against a woman because of pregnancy, childbirth, or a medical condition related to pregnancy or childbirth.
Genetic Information Nondiscrimination Act of 2008 (GINA): This law prohibits discrimination based on genetic information in both employment and health insurance.
Discriminatory behavior is grounds for account suspension or termination.
7. Intellectual Property
Users retain ownership of their content but grant Jobreel a license to use it for the platform’s purposes. Such use may include, without limitation, translation or modification for technical purposes (e.g. rendering on desktop and mobile versions).
Ownership of Content
User Ownership: Users retain full ownership of the content they upload to Jobreel, including but not limited to videos, images, text (such as resumes and job listings), and any other materials. This means users hold copyright and any other rights to their content as per applicable laws.
Grant of License
License to Jobreel: By posting content on Jobreel, users grant Jobreel a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, transferable license (with the right to sublicense) to use, reproduce, distribute, prepare derivative works of, display, and perform that content in connection with the provision and promotion of the Jobreel platform.
Scope and Purpose of the License
Display and Distribution: The license includes the right for Jobreel to display and distribute the content on the platform to other users and through different media channels.
Promotional Use: Jobreel may use the content for promotional purposes, such as marketing materials or public relations campaigns, to promote the platform.
Modification for Format: Jobreel may modify the content to conform to technical requirements of connecting networks, devices, services, or media.
Platform Enhancement: The content may be used to improve and enhance the features and functionalities offered by Jobreel.
Duration and Termination of License
Duration: The license is effective until the user removes their content from the platform or terminates their account, subject to necessary operational uses (such as backup or archival purposes).
Termination: Upon removal of content or account termination, the license will terminate, although residual copies of the content may remain in backups or archives for a reasonable period.
Non-Exclusivity
Other Uses by User: This license is non-exclusive, meaning users are free to use their content in any other way, including licensing it to other parties.
8. Liability and Indemnification
Jobreel is not liable for user interactions or any direct or indirect consequences of using the platform.Jobreel acts as a facilitative platform connecting job seekers and employers. Jobreel is not responsible for the individual hiring decisions or actions of employers on the platform. Users (employers and job seekers) are responsible for ensuring that their actions comply with all applicable laws and regulations.
Jobreel is not responsible for the unauthorized use, copying, or distribution of user content by other users or third parties. This includes but is not limited to screenshotting, recording, or any form of content piracy. Users agree to indemnify Jobreel against any claims or damages arising from their use of the Services.
9. Modification of Terms
We reserve the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms.
10. Governing Law
These terms are governed by Delaware State law.
